Current estimates of the numbers of people who will be forced from their homes as a result of climate change by the middle of the century range from 50 to 200 million. Therefore, even the most optimistic projections envisage a crisis of migration that will dwarf any we have seen so far. And yet attempts to develop legal mechanisms to deal with this impending crisis have reached an impasse that shows little sign of being overcome. This is in spite of the rapidly growing academic study and policy development in the area of climate change generally. 'Climate Refugees': Beyond the Legal Impasse?addresses a fundamental gap in academic literature and policy making - namely the legal 'no-man's land' in which the issue of climate refugees currently resides.

Starting from the question of how international law may protect the Pacific people from climate change, this book represents the original development of the international hybrid law concept, as the basic legal study of climate change from the environmental, human rights and refugee perspectives. From 2007 to 2012, the research conducted in the Pacific demonstrated that the most affected people by the gaps of international law are the vulnerable ones whose adaptation options are limited or exhausted, and are facing displacement.

The emergence of international human rights law and the end of the White Australia immigration policy were events of great historical moment. This book arose from an inaugural conference on Migration Law and Policy at the ANU College of Law. The conference brought together academics and practitioners from a diverse range of disciplines and practice. The book is based on a selection of the papers and presentations given during that conference. Each explores the unexpected, unwanted and sometimes tragic outcomes of migration law.
